Consumer Rights under PA State Law
Pennsylvanias insurance laws are not very restictive
to insurance companies but the few that are in place will
help prepare you for purchasing a coverage.
Policy Cancellation
All Pennsylvania health insurance policies include a guaranteed
renewable provision. An insurance company cannot deny
renewal request if there are no contract violations.
Newborn and Dependent Coverage
An insurance policy issued in Pennsylvania must automatically
cover newborns and adopted children for 31 days if the
policy already covers dependents.
Non Guaranteed Coverage
Pennsylvania laws do not specify that an insurance company
has to issue insurance to an individual. An individual
can be denied coverage based on their health condition
or past conditions.
Unset Policies
Insurance companies in Pennsylvania do no have policies
that are set by the state. This means they can tailor
their policies how they want. Insurance companies can
choose to cover or not cover certain pre-existing medical
conditions. This is called Elimination riders, and can
be added to any policy.
They can also set higher premiums based on current and
past health conditions and age.
Temporary Health Insurance
Insurance companies in Pennsylvania are allowed to offer
temporary insurance coverage. This coverage is helpful
if an individual is between jobs. Temporary insurance
coverage is not guaranteed renewable and can be cancelled
by the insurance company.
